Heritage Resorts

Whilst staying at a Heritage Resort in Spain, we were approached by their manager to see if we wanted to dispose of our timeshare and offered a way to do so. It involved paying a lump sum and in return, they took our timeshare (2 wks in Tenerife) so we had no further responsibility and gave us a 3 year introductory membership into the Heritage Resort Club with the promise of a holiday each year at a one of their resorts and at the end of the 3 years we can walk away knowing that we have no further responsibility to our timeshare and no requirement to join their club. I am concerned this may be a scam. Do you have any thoughts on this?

      Dear Rosemary, First of all, we have omitted personal information from your question.

      We have no reason to belive this is a scam, however, the resort may be offering a substitute contract because the existing contract you may have may be illegal in relation to Spanish law 42/1998.  this being the case, if you sign a new contract, this may preclude any legal challenge for refund or compensation through the Spanish legal system in the future.
