Do UK Timeshare Companies have to amend existing timeshare contracts taken out prior the Consumer Rights 2015 to comply with Current Legislation, or are the Owners covered by a previous Act.
Hi Barrie,
In Consumer Law we must distinguish between the Consumer Rights Act 2015, which is a general law that applies to contracts for the sale of goods and services and, on the other hand, the Timeshare Act (1992 or 2012), which specifically regulates timeshare contracts. The Consumer Rights Act specifically does not make any changes to the Timeshare Act, so the Resorts are not obliged to amend any contract. Each timeshare contract is governed by the law in force at the time of signing.
