    First of all, you could try terminating directly with your resort, however, you may experience the company being unwilling to assist you due to the loss of your yearly maintenance fees and will add a hefty admin fee and require maintenance fees to be up to date.

    The alternative to this would be to use a 3rd party company that specialises in timeshare termination. Initially, I would advise you to arrange a full review of your timeshare documents and history by a timeshare legal professional to find out what your options are.     The first thing you should do is locate their timeshare contract and read the clause regarding non-payment. The next thing is to ask your inlaws if they used a written form of communication to notify their timeshare company of not being home for an extensive amount of time and did they pass on an alternative way for communication for instance email?

    It is normal practice that a timeshare company will try all means of contact to have any outstanding debts paid, email, mobile, post etc.  Next, I would recommend appealing the decision by writing a letter to the company, explaining your inlaws reasons for non-payment and if you don’t get a positive outcome, you could seek legal advice.

    Thank you for your question and understand your concerns.  Before you sign anything, I would highly recommend that you have your documents old and new, reviewed by a timeshare legal professional.  Spanish legislation prevents timeshare companies from providing contracts over 50 years along with other rulings. Anfi have issued you a new contract in order to protect themselves from court proceedings in the future.

    If Travel & Leisure Group/Confused About Timeshare promised to return your fees and they were unable to sell your timeshare and is written in the contract between yourself and the company then the answer is yes.

    In our experience in current climates it is near on impossible to sell on a timeshare and do not recommend using services offering to sell timeshare, you only have to look on Ebay to see timeshares selling for as little as £1 pound. If you are looking to relinquish your timeshare liabilities the best options for a positive outcome are exit or a Spanish claim but this will depend on your personal circumstances to identify what timeshare you have etc. Should you require any further assistance, please don’t hesitate to contact us. 0800 520 2322.
