    I’m very sorry for your loss Joanna, in many cases we have found that Timeshares have been passed down as part of the estate in a will, however it is not always the case. Firstly I would ask the resort if you are liable to take on the contract and if the fees are still outstanding, if they will not allow you to exit the contract or they want to charge you the fees it may be time to seek some legal advice on how to exit the contract.

    I understand your frustration here, timeshare resorts will not allow you to reserve a week unless your maintenance fees are up to date. The majority of timeshare resorts have not compensated owners for the inability to travel during the pandemic,  and are being extremely difficult, it has left many owners questioning their reasons for staying with their resort.

    So to answer your question, yes they can do that I’m afraid and if you want to travel to your timeshare, you will have to pay the £980 requested. Unfortunately, we hear this a lot when you mention that the resort would purchase it back and then refused to agree to this in later years.  Furthermore, sometimes when maintenance fees are unpaid for several years, the resort can remove you as an owner so you would need to make sure they still have you confirmed as a current owner. In order to confirm what your rights are and what options are available to you, your timeshare documents would need reviewing by a timeshare specialist.
