    Dear Isabell,

We have had many situations similar to yours, which should not happen as the resort should have kept intact the holiday periods it committed to its customers. In addition, many customers have also complained that they have had to pay maintenance fees even though they have not been able to benefit from their holidays as per what was agreed.

The fact that the resort does not reply to your emails may mean that they have no solution or worse, they may have ceased trading.
We suggest that you obtain legal assistance as soon as possible to assert your rights as a consumer.

    Dear Tony,

The Mercantile Court-appointed administrator’s job is to identify assets that can be offloaded to pay back creditors. The Administration process for Anfi Sales SL & Anfi Resorts SL is at the early stages so it is too early to see what they uncover at the moment, they need time to study everything.   If you are considering a claim against Anfi, you will need to be allocated to the list of creditors which will require Spanish legal representation.

First of all, I have edited your question slightly for privacy.

The timeshare company will have no choice but to dissolve the contract.  You may want to send a letter to the timeshare company along with a copy of your client’s Death Certificate to inform them of his passing and state there is no next of kin to take over the timeshare.

    Dear Sandra,

I have to be honest and advise you that I have not come across this company called Timeshare Helpline Services & doing an initial search on Google I cannot seem to find them. Having said that they could be genuine so here are some quick things you can do to see if they are in fact genuine.

1: Do they have a website and how old is it.

2: Where are they located and what is the office address – put their address into Google maps and see what appears, does it look like a credible office that legal services would operate from.

3: Are they registered with their residing country’s authorities, for instance Companies House if in the UK and also look at how long the company has been registered.

4: Can they present you with actual proof they can fulfill what they are offering.

If you come across any red flags that this company is not authentic do not engage with anything they have to offer, it could save you a lot of money and anxiety.

If you are considering legal services, be extremely careful as there are a lot of unscrupulous companies out there. Dear Jeff,

Thank you for asking your questions via Timeshare Lawyer.

If you are saying that you stopped paying maintenance fees over 10 years ago and your resort has not contacted you all this time, it is likely that your ownership may have been terminated. If you are saying you paid maintenance fees for 10 years and have now stopped paying it, they could seek legal action for non-payment.

If you would like to know what options are available to you then we would need to know more about your ownership history. For more information, please contact us (UK) 0800 520 2322 (International) +44 800 520 2322 or message us on our online chat here: https://timeshare.lawyer/
