One way of finding out if you are still an owner is if you are still receiving maintenance fee invoices.   If you are not receiving those or anything else, there is a high probability that Island Village has cancelled your ownership due to non-payment of maintenance fees and means you won’t have the right to sell it on.

Further to your question, if you are the sole inheritor of your husband’s estate which includes a timeshare, and you do not want it, this makes it extremely easy for you to walk away from any liabilities that came with the timeshare but you must be 100% sure that you are not included on the timeshare contract.

Hello Colin I’m sorry to hear that,

I would suggest you try to find a way to exit this contract as they are charging you for a product you are unable to use. In many cases the contracts issued are incredibly binding and have stringent clauses that go against a consumer’s rights. In cases such as these by claiming against the contract’s irregularities one can receive a compensation such as the maintenance fees refund or even pursue a claim. The only solution is claiming these contracts are getting the nullity in Court. We have a lot of cases against Diamond Resorts and these contracts are not determined. We can take these cases and we will get the nullity in Spanish Court. However it is something we advise you be rather careful with as there are many unruly companies that do not comply with our standards. For additional information on companies you can trust or regarding your contract please contact us (UK) 0800 520 2322 (International) +44 800 520 2322 or message us on our online chat here: https://timeshare.lawyer/

    Dear Michael,

I’m glad you came to us with this question as you must be aware of certain companies. It is true that when you exit your Timeshare you must receive a certificate of relinquishment from your resort not only for peace of mind but also for any future incidences. In many cases fraudulent companies can merely reroute your maintenance fees to a different address to proliferate the guise that you have been freed from the responsibility of paying. In these cases one can in future find themselves with high outstanding debts. This is not to say it is your case of course, but you must be very aware and it is best to be in possession of one of these certificates. I would suggest we speak about your specific situation and in this way we can ascertain, to begin with, if you are still liable to a Timeshare contract; and secondly, to discuss whether the company you have been approached by is a veridical and legitimate one.

Thank you for asking your questions via Timeshare Lawyer.

It has come to our attention that many Anfi contracts are highly irregular, as per the date range it of course depends on where your resort is and what type of contract you entered if you are able to claim against it. The contracts are indeterminate if in the contracts the object (Suite Number, Plot Register..) or time are not defined (such as a contract in perpetuity or of an undefined duration) The Directive 94/47EC of the European Parliament and the Council was implemented in Spain through the Spanish Law 42/1998 enacted to protect purchasers of timeshare products, coming into effect on the 5th January 1999, but this also depends on what country you purchased your Timeshare in. I suggest in this case you seek more specific information, please contact us (UK) 0800 520 2322 (International) +44 800 520 2322 or message us on our online chat here: https://timeshare.lawyer/

    Dear Karen,

Thank you for asking your question.

I’m assuming by what you have written in your question that you are talking about being pressured into buying a weeks timeshare and are asking what can you do?

First of all, I’m unable to understand how long ago this purchase took place, however, if it was within the last 14 days, you are within your rights to cancel and this should have been stated at your meeting. If you are talking about a purchase made some time ago and are looking for some assistance, we would need to understand more regarding what you own and when you purchased.
