My timeshare resort was damaged by Hurricane Sally in 2020 and as repairs are being made they remain closed during my fixed week. I own 3 weeks and have paid over $3000. In maintenance fees for 2021. Now I’ve been told they have already rescheduled as many as they can and have no availability left for future reservations. And I will just lose my weeks. Although they are not refunding my maintenance fees. Shouldn’t the resort have to compensate the timeshare owners for their loss? The damage previously mentioned is being covered by insurance.

To answer your question, we would first request in WRITING that you request a refund of your maintenance fees OR that they offer a suitable week elsewhere. If they are unable to comply with a solution, your next step is to hire a local lawyer in the same state as your resort and arrange a letter to be sent from the lawyer and see if you receive a suitable solution.
