Whilst staying at a Heritage Resort in Spain, we were approached by their manager to see if we wanted to dispose of our timeshare and offered a way to do so. It involved paying a lump sum and in return, they took our timeshare (2 wks in Tenerife) so we had no further responsibility and gave us a 3 year introductory membership into the Heritage Resort Club with the promise of a holiday each year at a one of their resorts and at the end of the 3 years we can walk away knowing that we have no further responsibility to our timeshare and no requirement to join their club. I am concerned this may be a scam. Do you have any thoughts on this?

I am considering coming out of Diamond Resorts and being over 75 we are able to do it at no cost? But if we came out of the contract first, would it jeopardise a claim for unfair contract, breach of contract and fraud by selling timeshare concessions through Booking.com, Diamond Hotels whilst not releasing availability to members whilst charging members full Management fees.

I am writing the answer here because something needs checking as our website does not show where to place the answer,,,

Dear Barrie,

Cancelling your contract would jeopardize a future legal dispute against the resort and the chances of being awarded compensation. If you would like to find out what your rights are and what options are available to you, please feel free to contact us: UK 0800 520 2322 / International +800 5202322.

We bought two one week timeshare units on Mc Donalds Dona Lola on private re-sale in 2002. We paid our service charges and used our weeks until 2019, we paid 2020’s charge but could not use due to Corvid, we didn’t pay for 2021 as restrictions still applied. Mc Donalds continued to peruse payment and have now instructed solicitors who are being very heavy handed, Ideally we would like them to write off the disputed weeks and do a deal relative to handing back our weeks.
