    Dear David,

I am sorry to hear of your personal circumstances,

Regarding your question about the solicitor, it will depend on exactly what the solicitor wants payment for. A timeshare is generally purchased direct with the resort (to avoid any future ownership or contractual issues) so therefore no need for a solicitor. Your wife should be cautious using any 3rd parties for the purchase of a timeshare and make sure they are legally qualified to practice.

    Dear Rebecca,

The advice you have received regarding a Spanish contract and that the timeshare is a floating week is correct, there is a high probability that you can claim as these contracts are indeed illegal in Spain, (subject to a timeshare legal expert review of documents & history). One of the Spanish court rulings implemented in 2015 to protect timeshare consumers is that contracts must include specific information regarding the property.

Regarding the way you were approached and the fees, many of the 3rd party timeshare claims companies operate this way both good and bad. If I may point out that court costs often exceed £5,000 depending on what is required.
