Firstly I would ask the resort if you are liable to take on the contract and if the fees are still outstanding, if they will not allow you to exit the contract or they want to charge you the fees it may be time to seek some legal advice on how to exit the contract.

In order to receive funds from the court, there needs to be a lot of work done to prepare the case initially, you would have been asked for documentation such as a timeshare Purchase Agreement, your payment history etc, in some instances a Power of Attorney needs to be arranged and a lawsuit submitted to the courts. These types of actions would not be done without you having contracted legal representation.
