    In response to your question, most of the time, resorts try to keep clients on board as long as possible due to the fact that maintenance fees are their primary income source.  They also can charge owners a hefty fee if you are granted the option to leave.

    We have no reason to belive this is a scam, however, the resort may be offering a substitute contract because the existing contract you may have may be illegal in relation to Spanish law 42/1998.  this being the case, if you sign a new contract, this may preclude any legal challenge for refund or compensation through the Spanish legal system in the future.     We hear of many owners in this situation, unfortunately, and yes we agree it is not right to have to pay for something you couldn’t use. Unfortunately, it is very easy to purchase a timeshare but getting out is very different.

    If you are looking at the options to get out of your timeshare, the resort will make it quite difficult for you especially if you have not paid maintenance fees due to this being their primary income source.
